Discrimination in the workplace - Do I have a case?

  • I have been employed with the same employer for 12 years. During the 12 years I have ask my manager and supervisor for cross training, to attend company workshops/training classes to better myself, gain new skills so I can become a better employee and to give myself the opportunity to advance. The opportunities have not given to me. There is this workshop called CBMI, that I have been wanting to go to for 12 years now. I haven't been given the opportunity to attend, but my manager and supervisor and other employees have attended. We have 3 people in our office, the manager, the Administrative Assistant and Staff Support which is me. Our office handles payroll for employees who are biweekly, monthly, students. My department hired a new person in July 2007. They wanted to make this person an Administrative Assistant with more pay, but that didn't happen. They made her the same as me Staff Support, but gave her more hours and more job responsibilities. She came in taking half of my job responsibilities and some of the Administrative Assistants job responsibilities. The company was already in a budget crisis. The new manager ask me why did they create this new position and hire this new employee. I would like to know that myself. Our office didn't need a 4th person to handle the payroll. I was there and could do the job, but they wouldn't give me the chance and they didn't give me a reason why they didn't give me the opportunity. My Performance Evaluations and score have been the same (copy and paste) for six years. August 2007, I had a second interview with another department within the same institution. The hiring OFFICIAL went to HR Records to view my personnel files. The hiring OFFICIAL notice that my Performance Evaluations and score have been the same for the past 6 years. The hiring OFFICIAL called the manager of my department and ask her why have my PE's been the same for 6 years and if she knew about this. The department's manager told her that she just took this position from the previous manager who left in June 2007. When it came time for our 2007 Performance Evaluations my supervisor who is the Administrative Assistant gave the new hire a better PE, with a high score and gave me the same PE and score she had been for the past 6 years. In August 2009, our office now has a third (new) manager. I had talk with our new manager in person and through email (s) asking her about me getting cross trained by my supervisor on working with students and taking on other payroll responsibilities. She or my supervisor has never answer or responded to my emails or started the process of cross training me. My supervisor who also handles payroll had left early that day, which was a payroll final. She did not have all of her payroll in at the time. She was missing a couple of students. The payroll manager took a vacation day this day. I was the only one left in the office and I wasn't made aware of the situation and her boss was calling looking for the payroll manager and my supervisor and neither one was there. Well someone walk in with a batch of students time sheets that needed to be enter. I did not enter their working hours in the system, because I've never done it, nor have I had the training. Well they didn't' get paid. A couple of days later the manager calls me into a meeting and writes me up. Telling me that I'm not a team player and that there was no reason why I couldn't process their payroll. She said that I should have called her if there was a problem. I explain to her that I have never processed students payroll, I have ask you and my supervisor for training, but I never got it. She wrote me up anyway. I was the only one in the office that got a write up. There is lot's more to tell, but my hand is getting tired. Do I have a case or what?

    No you do not have a case! Apparently your opinion of your job performance is higher than your last 3 supervisors. They do not have to allow you to cross train on other jobs. You were hired for a specific position and that's where they want you to work. The fact that they have given newer employees better appraisals and opportunities is not relevant to you. You have the option to accept what they are offering you or look for a new job. You probably should have done that several years ago and moved to a company that would appreciate what you have to offer.

No you don't have a case, but I would take all of this information to Human Resources. Let HR know you have pursued training on numerous occasions, and you don't feel as though you should have been written up as you have never been trained for the specific duties you have been written up for.
