What is the reason for leaving your present employment?

Record of Employment and Employment Ins ?

  • Recently I departed an employer who after 6 weeks and counting still has not provided me with a record of employment. I have reported this the Canada Employment ( 3+ weeks ago ) and to date nothing has arrived in mail, no phone messages, nothing. The reason for leaving was simple in that the hours agreed to over the past and upon hiring me ( and agreed to by both parties ) simply were not being offered "Going Forward" as they put it. I finished that shift and that's all she wrote. I went back on two occasions to check the scheduled hours ( that I could not accommodate ) and they were not going to offer the hours previously agreed to ( worked those hours the better part of 2 1/2 years ). Am I to understand that an employer can change his/her mind whenever they wish and since this is a non-union work environment there is little I can or could do, other than to leave and seek more suitable employment. I am a father of three young children so finding hours that work of course are a challenge and won't happen overnight. I am being held up in being able to collect employment insurance benefits because my former employer has still not forwarded the ROE. They have provided me with annualized vacation pay ( if that is the correct term for monies owing from last date of vacation with pay to departure date ) and of course they have cancelled my employment benefits and discount card etc. What are my rights here? Thanks.

  • Answer:

The failure of your previous employer to provide an ROE is not holding up your EI claim. You did the correct thing by advising EI that you did not receive the ROE. EI will follow up with your previous employer. In the meantime, you should have already applied for EI even without the ROE. If you would like, you can contact Service Canada to get a status update. Keep in mind it usually takes 4 weeks to hear back from EI once you apply.
