Collecting Unemployment after being laid off and employer claims i quit?

  • was working for a contractor for fedex and my route got sold to another contractor and didnt get a job offer from the other contractor, filed unemployment a month ago, took a couple weeks to get approved and another week to make the debit card and recieved payments the last couple of weeks now this weeks payment has been temporarily suspended because my employer claims i quit, which is a lie.......first its a lie, second i thought they had like 10days to argue this claim.......he says his accountant handled it and that he would have her call in to cancel it............he then tells me that she called in and its taken care of...........i call unemployment today and they said they have received nothing and that if they did they would of advised them to have a written statement.....so its lie after lie..........now he says he called his accountant and left a message to figure what the problem is...............this is frustrating because i need the money while i'm trying to find a job.......i just got emailed a statement from the contractor that bought the route and says he bought the route from him and that he already had enough drivers and so i didnt offer him a job on so and so date after the last day i worked.................now not sure what goes on in getting the facts for unemployment to decide whos right from the phone interview.................i mailed and fax this statement from the other contractor and have written down everything im going to say and all the lies that my employer has told me and that they had called in and all that................not sure if when you quit that if there is documentation or if i would of had to sign something...........which i have nothing, i definitely did not quit, i tried my best to stay on.....................just wondering if this statement from this other contractor is enough to win this battle..........any advise is welcome or what you think

    Do you have written proof that you were terminated (laid off)? If so, send it to the unemployment office. If this is happening as you say, your former employer is committing fraud against the labor department, and they take it pretty seriously.

When you file for unemployment, the employer has the opportunity to challenge your claim. Sounds to me that he said you quit voluntarily. At this point, the unemployment people should interview you a second time, to hear your side of the story again. Based on what you say and what your employer said, they will make a ruling. If they rule against you, you can appeal the decision. There's a whole legal process for this in which you go before a hearings examiner. My understanding is that you can bring an attorney with you which might not be a bad idea, considering your lack of documentation. Talk to the unemployment office about your options -- they will tell you what to do. edit for correction
