  • I was a director at a day care center. I was involuntary demoted almost 2 weeks ago now. My job was given to the bosses friend. I've asked my boss put the details of my demotion in writing but she refuses. I also asked if she could officially change my job description on record, again. she refuses. Instead of doing so, she has proceeded to write me up for minors thing and trying to bully me into quiting. My work place has become very hostile and stressful, leading to many days where I have killer migraines, I live in the state of Delaware so I'm unsure what my rights are. I'm almost certain she is not following the proper labor laws. I want to seek legal advice but can't afford a lawyer. Please Help

    Do you have a written contract when you took this job? Are you union? If neither, they do not have to have details in writing of your demotion or job description. You are most likely "at will" employment, meaning they can fire you for any reason, or you can quit. The writing is on the wall. They want you out, so they want you to quit, which means if you quit, you would also not be entitled to unemployment benefits. Update your resume, since if not, with them now writing you up for minor things, it appears they are looking for ways to fire you. It sucks, good luck

She is a private company. It is not illegal to change your job and replace you with someone else (friend or anyone else) She is not required to document the situation. It might not be right. It might not be fair. But it is not illegal (research at will employment) Just look for another job.
