Legal question about a law suit.

Privacy Question Law suit maybe?

• Okay so i had my phone out at work. Wasn't on it... it was just on my desk. My manager took it. Rules are you cannot be on your phone or have it out on the call center floor or it will be taken away. What happens if my boss decides to go on my phone and go through stuff and put things up on facebook? What action can I take? Isn't that private property? Can they be sued?

  Anyone can sue anyone else for anything. The question is: Do you have a viable case? You probably signed something when you took this job that said something along the lines of "an employee should have no expectation of privacy... and we can search your personal belongings..." It's typically in an employee handbook. So they MAY have the right to search your call log and usage history to discover what activity occurred on company time. Them using your personal phone to communicate in any way would be the problem - but you intimate that this has not happened, but you are concerned that it could. Should that happen you would want to gather the evidence to support what they have done and speak to an attorney.
