Should i consent to a background check after being permanently placed by a temp agency?

I recently found a job through Robert Half (Accountemps). I filled out all of the necessary paperwork and gave them consent to do a background check. Well I started my temp job and after my trial period, the company I was working with decided to bring me on permanently. I go in to do my background check and something comes up on my background. I had a misdemeanor expunged about 4 years ago, and it shouldn't have showed up. I brought in a copy of the papers and everything is fine. All of the paperwork has been filled out and I am officially employed by this company. Now I get an email from RHI saying they need me to consent to a background check before I will be hired. I have consulted with the HR department of the company that hired me and was told not to consent to this because I am no longer RHI's employee. It seems like something fishy is going on? It seems like they never ran the background report the first time and are trying to save themselves. I have been getting several calls from RHI trying to make me consent to this background check and that it is so they are compliant. I talked to other people who came through RHI and were brought on permanently and they said they never had them contact them but RHI says that it is standard. I am not sure what to do here because I really do appreciate them finding me a job, but I feel they should have done this the first time(I would have been fired because of the misdemeanor) so I would have been prepared in case it showed up there too. I need some advice on what to do/what is going on.

This is all you need to know, that the Company that hired you permanently gave you this advice: Quote, "I have consulted with the HR department of the company that hired me and was told not to consent to this because I am no longer RHI's employee." unquote. Let the HR dept of your present Company know what is happening, they will know what to do to get RHI off your back.

If the record was expunged, then it should not have shown up on the report. You have the right to a copy of the report. Your rights are spelled out in the Federal Trade Commission's document, "A Summary of Your Rights Under The Fair Credit Reporting Act". You can Google that document and find a copy. I would strongly encourage you to find the source that is reporting the erroneous information and have them correct it. They are obligated to do so. Otherwise, you may have to explain it every time a background check is run. You can check out the Federal Trade Commission's website. There, you will out all you need to know. If RHI was not my employer or signing my checks, then I would not give them consent either.
Yes depending on the agreement the agency made with the company the company you work for can request them at any time to have this done. MOst agency put in the contracts that they may ask to have a police report done. May is the key word here meaning not always but depending on the company they are being payed by and there agreement if the company ask for it or if its a detailed job that deals with the public or money matters etc. then yes this can be done and at ANY time the company wishes. If they feel there is a need or are unsure and some companies its mandatory as well. I have seen agents come through a temp service to work on contract for a year to an outsourcing company and not until the company decided they like you or have room for you wish to hire you full time permanently is when they can request this and many people then get upset and panic and then call the agency saying they have a record and they've wasted a year there and now won't get the job because of this. thats the price you pay in the end. If the company wants it they are allowed to ask that you get it. If you don't they can legallly let you go so read your fine print.
Something stinks here. Appears to me that someone is covering their you know what. They may have failed to conduct the background check and were questioned by the company you are employed with. It's between RHI and your current employer. Refer them to the HR dept.
