Is business law and commercial law the same thing?

Business Law Case Study... Help?

  • In my business law class I am a judge for this case study. at the end of the case we are supposed to ask questions about it, but the thing is I am so confused about the case. I don't really understand it and have no idea what questions to ask. I don't want to look stupid when its my turn to ask questions so I am asking for help. And if anyone could just reexplain to me what its about and maybe give me tips on questions to ask. Here is what I know about the case so far. An auto company sold a used car to a 17 year old in oregon. He talked about how he went to OSU so the company assumed he was 18. He payed 500 down and payed like 156 each month. He ended up crashing the car and left it in his front lawn. He stopped paying for the car in October which is the month he turned 18. The company is suing him for not paying for the car but the kid says he doesn't have to pay for it since he wasn't 18. So that is that case. I just am not sure what type of questions to ask. Any advise would be great!(:

  • Answer:

Was there a contract? If so, was the contract signed by this minor? Was identification presented by the minor that was fictitious? What is the age of majority in Oregon? Can a minor sign a legally binding contract? Was the minor ever asked his age? No signature no contract. This is all about the signature and if Oregon law allows a minor to enter into a contract.
