How long does an employer have to contest unemployment benefits?

Can I take a buyout option from my PA employer and still be eligible for Unemployment?

  • I was recently given a 30 day performance notice that if I didn't improve, I would be terminated. I was also given a buyout option and told that my employer does not contest unemployment determinations. If I file as laid off (technically true), would there be any way I wouldn't receive unemployment benefits?

    If you accept a buy out offer you are resigning which would make you ineligible for UI. By saying they don't contest doesn't mean they lie for you. That would be a felony.

If you voluntarily take a buy out option, you voluntarily leave the position. You do not qualify for unemployment. To get unemployment you are terminated from your job due to no fault of your own. If they let you go due to downsizing or lay you off for seasonal work or for outsource project or something like that, then you can get unemployment because the business let you go. If you go on your own of if they pay you to volunteer to go, then you do not qualify for unemployment. You have been told that they do not contest unemployment---I doubt this as it means money out of their pocket to pay you and if they already paid you to leave, they will probably not continue to pay you through the unemployment program too. That would be bad business. Plus, like another here already said, they would be breaking a federal law if they allow you to fraudulently get unemployment

"does not contest unemployment determinations" Unless you fill out the paperwork incorrectly, you shouldn't have an issue...

Weigh your options...if you received severance pay ..etc...it would hinder your unemployment. And if you did get severance, your unemployment may be a lot less.
