OK let me explain this is very confusing. First of all my father in law died of Cancer Thur. He is married to my mother in law but has been separated for 10 years He has two sons my husband and his step brother He was dating a women for 2-3 years before he died He always called My mother in law and talked if anything happened that is who he called up until his death. We were told two months before he died he had cancer we went to see him in the hospital There the girlfriend would not let us be alone to talk with him We did not know where his father lived in Indianapolis and had no way to get a hold of him When at the hospital his girlfriend said he is getting married to her and my mother in law said he is still married to me well the gf didn't know that. He assigned her the power of attorney over medical and the funeral services. We hadn't heard anything about his father and when attempted to call the numbers giving to reach him no one would answer And he hadn't called my mother in law for the whole two months. Well on Friday we received a call that his father had died. but only my husband was made welcome to come to the services. so we went to the a private showing the funeral home We were not informed on any arrangements at all pertaining the Funeral In the obituary my mother in law the wife was not even mentioned. But his fiancee and best friend the girlfriend was. My husband was not even allowed to be the Paul bear but his nephews were and his girlfriends sons. He use to have a life insurance policy and my husband was the only beneficiary. My husbands grandmother told us that the girlfriend have POA has changed it to her. by the way he had brain cancer when he signed her over as Power Of Attorney. At the funeral the flag was given to the girlfriend the veterans states it should go to the next of kin the wife then the mother if she did not want it. We do not know if there is a will. What do we do? We need help finding out how to find out information on the will, insurance, social security, veteran, pension from his employment and he owed thousands of dollars in child support.

Different states have different probate laws. If he was indeed legally married to his first wife at the time of his death, that would change the picture somewhat. Without knowing what state you are referring to, there isn't much we can do to help you here other than advise you of two things: 1-Find out what lawyer is handling the estate 2-Hire a lawyer of your own

wills have to go through Probate, which means they will be public record.. Find out his lawyer and they should be able to help you.. If you think the girl friend got POA over him while he was NOT in his right mind, you are going to have to take her to court.. As for the funeral and flag and obit, that is just someone being a ***** and not much you can do about it now.. sorry..

I would first contact the life insurance company and see what they recommend. If she is the girlfriend then she has no legal claim to any of this estate. They are not legally married according to your post you mention her as the GF. If you claim his estate your Husband will be legally liable for any taxes, liens, collections, payment etc...you should also contact a lawyer as well.
