What legal benefits am I entitled to as a full time employee in a small business company in New York City?

I have been working in a small business company since the end of August 2008. My boss does not have experience with having employees, other than himself and his wife. I would like to know all the benefits provided for a person when working on the books a full 40 hour week in New York City. Such as how many paid sick, personal and vacation day that an employee is entitled to. If a person is entitled to get paid for national, legal, religious holidays, and any other benefits that I may not have mentioned. I honestly don't know where or what I should be looking for. So, if you have any information that can help me, it would be greatly appreciated.

1) For most federal/state statues, a business must employ a certain number of employees before it is subject to those regulations. If it is just a small team, they are exempt. (w/ exception of certain OSHA, wage/hour laws, etc.) 2) Vacation days, personal days, holidays, etc. are not something you are legally entitled to. These are BENEFITS that employers offer to different degrees. Your boss can schedule you to work any holiday, offer no vacation time, and not pay you for any days you don't work. It is your choice if you want to work there or not. 3) Change your attitude. You employer owes you a paycheck, nothing else. Instead of looking for how many days can you get paid to sit at home and watch TV, you should be thinking about what new skills can you learn in this job and how can you make it help position you for your future career growth.

I am pretty sure that a lot of the labor laws don't apply when there are less than a certain amount of employees working in that company. He probably has to offer you health insurance, but that could be it. You need to contact your local labor board and ask them. I know in Ma if a company doesn't have more than i think it 7 employees they dont have to pay time and a half for sundays for example. Oh, and If he isn't paying you on the books, you are entitled to nothing.

benefits are not regulated by law it is a gift and as such can be given or not given at the will of the company
