I was given 2 options @ work, get laid off,collect unemployment or take a pay cu, keep my job. Is this legal?

Needless to say i took the job at a 25% pay cut (SALARY ) . Now here is the kicker, i lost my job title, BUT my job duties stayed the same and i get to help out the accountant with the three other companies... they got a bargain out of me =-( Now that thanksgiving is coming up i was told that was not a holiday pay and that i would NOT be paid if I missed that day and friday (I'm driving to LA). Which if i were hourly would be acceptable... but IM NOT. I'M ON SALARY. Can the company legally get away with that?

Specific labor laws will depend on what state you're in. If you don't have an employment contract, then chances are what they did was legal. The state I live in (Florida) is an at will employment state... so an employer can fire an employee for any reason, without notice. At least you were given notice, and better yet, an option (even if it wasn't much of a choice). Check the statutes for your state, or say what state it is and I'll check them out for you.

they can because you agreed to it; you should review your contract regarding the specifics about the holiday pay days. i'll be honest with you, as a small business owner, this is what employers often do to employees that they don't value too much. its not personal, its just that if you are layoff-able, youre expendable, so you can expect them to abuse you like this over the course of the next few months before it becomes unbearable to you and you quit. to them, if they get 4 guys to accept the cut and stay, then they have a free employee. so yes, it's entirely within their legal rights to do this, assuming that you dont have something in your contract stipulating otherwise. my advice to you: they dont want you, theyre taking advantage of you, so start searching for a new job. make sure you ask your prospective employers not to contact your references yet.
