What is minimum wage in Wisconsin?

Is my employer required to follow federal and state minimum wage laws in wisconsin?

  • Is my employer Subway required to follow federal and state minimum wage laws in Wisconsin? Or are they required to follow one but not the other? The company is run by people who seem less than educated on wage laws, and I know from previous experience that if a company can rip you off, they will try. So any sort of help to educate me on the wage laws would help. What differentiates a company from having to follow state or federal, one or the other or both laws? Thanks!

  • Answer:

Subway, yes they are required to follow both laws - minimum wage for you would be whichever is higher.

Federal laws mean "every state must comply" state laws mean the " entire state" must comply so the answer to your question is YES

Actually, state law, if it is BETTER for the employee than federal law, must be followed. No employer can do less than the federal employment laws, but if the state law provides a higher minimum wage that federal, then the state law must be followed. Current federal minimum wage is $6.55 -- no state can go below that. However, there are some job classifications within each state that do pay less. So check out your state's Department of Labor web site.

In your case, it will be a little bit complicated. In order to make FLSA (Federal Minimum Wage Law) to apply in your situation, you must be able to prove that this Subway store is not a franchise location, but a corporate store, because it is only a franchise and it does not have any business acorss stateline (interstate commerce), FLSA usually does not apply to you. See below for detail. http://www.dol.gov/compliance/guide/minwage.htm Therefore, in most of the cases, state law apply.
