YouTube copyright info?

Question about the dispute status of my youtube video?

  • This is really a question for someone who has a lot of knowledge about youtube and the copyright system they have. i made a video using a song which I'm sure is in fair use. It contains lipdub and the track has been modified, along with other things that i believe make it fair use. But the track was matched using youtube's copyright matching system, and even though my video was still available worldwide, i did'nt like seeing the ads on my video, and seeing something that could prevent me from getting a youube partnership in the future, so i filed a dispute, saying it is fair use. It has been almost a week. what i want to know is if there is a time limit that the copyright holders can respond to, before I "win" the dispute. Any info you can give to me on this would be great. thank you.

  • Answer:

What you are describing is certainly not fair use. It would only be fair use, if you are making a commentary or critique of the originally copyrighted material, which it does not sound like you are. Also, by altering the original content, they might decide that you were trying to bypass the copyright detection algorithm they have. If that is the case, disputing the claim might bring it to the attention of an actual human being. Once that happens you could actually be sued.

The use you describe does not qualify as fair use. If the copyright holder chooses to continue pursuing you despite your attempt to dispute their claim, you could be in for a lot of trouble, since they might decide to drag you into court. They have several years in which to do this, so they might come after you at any time. Be glad that they just put ads on your video, instead of blocking the video, closing your account, or filing a criminal complaint. Although, now that you've filed a dispute, you're no longer dealing with computers, you may be dealing with people. And that puts you on the copyright holder's radar, which may backfire for you. Don't use songs in your videos unless you have permission to do so from the copyright holders for the songs. Then you won't have any trouble.

YouTube didn't make the copyright system. Copyrights are laws created and agreed upon by several of the world's governments. You are mistaken concerning "fair use". In order to legally modify an audio track, you need to have prior written permission from the copyright holder. I didn't read anything about your having such permission, so your dispute is destined to fail. Educate yourself regarding the laws before you assume that you are covered by "fair use" statutes.
