Is it legal to put a video on Youtube that has music?

  • About six years ago I made a video of me and my horse before he was put down and set it to the perfect song capturing our bond. Actually though, I'll admit my horse was leased from someone else (he was mine to me!), and the owner later published a book that had both him and me in it as well. She was wondering whether it would be legal to post my video to her book website and/or Youtube. We don't want to violate any copyright laws, though. I know a lot of Youtube videos get blocked or the audio disabled because of violations, but I've also noticed that some videos have the link to purchase the song used in the vid from iTunes. Is this a legal way of using a song in Youtube videos? If not, how would I actually go about getting permission from the company who put out the song so we could use my video? Please and thank you!

    No, it's not legal. It's unauthorized publishing. Read the back of a CD you may own it'll say "Unauthorized duplication is a violation of applicable laws" or "FBI ANTI-PIRACY WARNING : unauthorized copying is punishable under/by federal law" That automatically means You have no legal rights to publish the music. You can't get permission without paying thousands, maybe even millions to license it LINKS to iTunes are videos that are monetized or official monetized videos are allowed to stay up, which rarely happens anymore. And just because a video is monetized doesn't mean you're off the hook. You still get a strike and still risk losing your account.

Getting permission unless you have connections in the music world and can contact the record label directly are slim to none and most likely you'd have to pay to use the song in your video so that isn't an option. Most songs are copyrighted so when you upload them online on YT that is illegal. The videos you see with ads underneath for itunes were put there automatically by YT because the company that owns the song wants an ad on it but there is no way to know (unless you upload your video) if your song will get an ad or just be blocked worldwide. I'd stick with royalty free music - no issues.

Illegal to publish someone else's music without a license, for just about any purpose. You CAN get a license and it may be inexpensive for your particular (limited) use. Just contact ASCAP, BMI or SESAC for a quote on how much it might cost. The alternative is to wait until it's too late, get caught uploading (publishing) music without a license, and get sued. Ask the Minnesota housewife caught "sharing" 24 songs on the internet, refused to pay a $3,000 offer of settlement (i.e, what they thought the licenses were worth for the number of copies she'd made), ended up going to trial and getting ordered to pay $80,000 per song ($1.92 million). Violating only comes on the internet when the original owner sees it and asks the website to block/ban/delete it from the website. Happens many times on youtube with songs,programs in the video. Some people avoid this on youtube by "mirror-ing" the original video so it's technically not "copying" the original owner.

If the music is copyrighted you are not allowed to earn any money from youtube and sometimes they will remove the video. Other times it will say you can earn revenue. And other times it will ask you to switch out the audio from youtube with non copyrighted music. Sorry for the bad news
