Question about internet shut-off / looking at files -legality?

A friend told me that her internet was shut off due to excess usage. they suspected illegal downloading. How much would trigger a red flag? Is this something that was maybe written in some sort of contract? Because I don't remember signing anything contractual saying that I won't exceed X amount of usage. Also, she said they sent some sort of tracker thing that looks into her computers, looking for illegal downloads? Can they do this? Is that legal? Wouldn't that invade privacy?
