Why do people give false information on getting a tattoo license in NY STATE?

I have read more then 100 answers that are uninformed on getting a tattoo license in New york STATE! Not just NYC! Example, one so called 9 year vet stated this: "You need a studio to work out of. It's illegal to tattoo out of your home. And both the studio and yourself need to be licensed by the health department in your state. You need to pass a blood borne pathogens course, and be actively employed at a studio that is already licensed in order to legally tattoo, in most states. New Mexico, and New York are two of the unregulated states. There are a couple of others. When a state is unregulated by state law, the local laws, city and county; preside. In New Mexico, only animal tattooing is regulated. Like if you want to tattoo serial numbers on thoroughbred animals for identification purposes. You have to be state licensed to do that. Tattooing illegally on minors is a felony in quite a few states. Not smart. With the proper courses passed, and clean, sanitary room, and sterile equipment you can get a license to tattoo from your home. An apprenticeship is a great thing to have, but is NOT a requirement! You do not have to be working in a tattoo shop to apply for a license! Tattooing from your home is more difficult to get a license, but if you run a tight ship it IS possible. You may need a variance from neighbors, meaning they may have to sign a list stating that they have no problem with you having this business in your home, and you may need to prove parking won't be an issue. Most people that run legitimate tattoo shops in their home do appointment only. They don't have every Tom, Dick, or Harry just parking and walking into their home. It peeves me to no end when a scratcher states they have 'X-Amount Of Years' in the business, and state such crap, yet they never state what shop they work in as a source. Really? Gimme a break!!!!! I tattooed from my home for 11 years with certification, shop was called ( HA! Yeah right! You don't state where you work, why should I state where I worked? ). Then life happened and I moved away from the state. Then, life happened again, and I moved back home. Time to start my business again. Reading all the frikin' fluff many people have to say is misleading, to say the least. Some give accurate info, and others just answer to get a ranking. So.......... My question is simple, what gives you the right or knowledge to state who and where you can get a license to tattoo in NYS?

You actually bring up why this question probably should be asked under a Business Category. Probably 98% of the people, in my humble opinion, who ask this question are not serious about the work it takes to open a business. That mini rant aside there is a huge difference between tattooing at home and having a home tattooing business. For example my Grandmother had business, beauty shop, that was located in her home. Part of the rules were that it had to have it's own outside entrance, be separated from the rest of the house, and have it's own bathroom. Of course she had a shampoo sink, dryers, and clean towels for every customer. That's whole different set-up than someone doing the same thing out of the kitchen sink. Anyway good luck with your business.

I am not sure how a hair dresser and a tattooer are on the same page, that wasn't an answer to the question. Not even close. First, yes you can get a license to tattoo from your home. You need a private room that isn't traffic heavy inside the home, and it needs to either have a sing in the room, or have a sink and restroom close. You might also need a room for people to wait in while making a stencil or drawing a custom design. You are right, the health dept will be harder on you the a shop owner. You will have to be above and beyond sanitary! What gives me the right? Tattooing for 17 years as a professional gives me the knowledge and right. Yes you can get a license to tattoo from your home in NYS.
