How to beat my open container ticket?!?

  • I got a M.I.P. alcohol and Open Container ticket...btw i am 21 I got drunk and all that had whatever, then I got in my friends car for a ride home because I was obviously drunk, It was 5 people in the vehicle the driver, some in passenger and I was on the left side in the back and of course 2 people next to me. We got pulled over(high beams) all got breathalyzer tested just because the "smell" i failed of course and got a M.I.P. (im 21) along with everyone but the driver. The officers then searched the vehicle and found to open bears under the passenger seat...I had no clue there was beer in the car...any way i can fight this?

    I'd give it a try. Shouldn't that be the drivers fault? It's his car..his insurance! How can they prove the beer was yours? So what if you were drunk you weren't operating the car! I'd fight it.

Let me state the obvious: You can't get a ticket for Minor In Possession as long you were of legal drinking age at the time the ticket was written! He must have miscalculated your age from your ID. No big deal, go to court and present your ticket with proof of age; that would be your ID/DL. Let the judge determine your age. As for the open containers, say this, "Your Honor, the open containers were under the front passenger seat, I was sitting in back behind the driver seat, the containers do not belong to me, I plead not guilty." It is the responsibility of the officer to prove they belonged to you.
