Do Cops in Iowa have to show up for court for a traffic ticket?

  • I got a seat belt ticket the other night while driving home from work. The cop was a complete dick to me so I would like to not pay this ticket if i do not have to. Its a 127.50 ticket and i have never even had a speeding ticket or anything here and I was coming home from a pizza delivery job where I am in an out of my car constantly and forgot to buckle up after a long day of work. I just think a warning would have sufficed. FYI i was not speeding or doing anything else he pulled me over purely for the seat belt. If it depends on county this happened in Story County in Ames, Iowa and it was an Iowa State university Bike cop (I know BIKE COP). The reason i ask is because I'm originally from nebraska and i know that at least in my town they changed it to where the cop does not have to show up in court. Most states i think still do the thing where if the cop does not show up you automatically win.

    Nope he or she doesn't have to show up. However, if they don't show up, the case against you should be dropped. But I don't know what the specific law in your state is on this. I know in mine, you can contest the cop not showing up. You should also counter sue him or her too for being a "dick". You can do that once you get to court. Just be there earlier than the date time to do so. Good luck with that.

In most states the officer does not have to show up unless you plead not guilty then the officer has to show up to tell their side of the story in front of the judge however I will advise you against this because you already admitted to having broke the law. The excuse that the officer was "a dick" or "I just think a warning would have sufficed" would not be valid in the court room. Sorry but that is how the law works.

I was a bike cop, not for a college but a large city. Wrote more moving violation when on a bike than when in a car. It neither depends on the state or the county but the department. No idea what a U department's rules are but honestly, what else to they have to do? My department if you do not show on your previously assigned court date and are not in another more important court you get a day off without pay. On top of that whoever said the case should be dropped is nuts. Up top the prosecutor to ask for a continuance if he wants and the judge normally grants it. Just as you, the defendant, can get a continuance so can the prosecution.
