What is a transparent order?

What is law and crimes different between NO CONTACT ORDER and RESTRAIN/PROTECTIVE ORDER?

  • As I know what restrain/protective order meaning. If broke it then can get arrest. What about no contact order? Exact same as Restrain/Protective Order? If so why court use no contact order if can use restrain/protective order? Maybe the crime are different if broke no contact order and restrain/protective order. If so how crime and punishment are different?

  • Answer:

The difference is based on the relationship and reason for the order. An order for protection is for people in a domestic qualified relationship to keep them separated. A harassment restaining order is for just about anyone that wants extra protection from the justice system to keep someone away. A no contact order is something issue by the court. All three of them are basically the same in the way they are enforced. No matter what you are not to have any direct or indirect contact. period. The only real difference is at least in my state the no contact order doesn't require a hold for court upon arrest.

there are 2 types of orders of protections (op) first type is a stay away op....or no contact....means person must stay away from, do not call, text, email, mail,,,,etc......] second is a refrain from op......meaning person must refrain from committing any type of criminal activity against the person, no assault, no harassment, no stalking, no stealing from...... the law for breaking them is the same....criminal contempt.....now if there is either order and there is physical contact, it bumps charge up to a felony..... ' 'the stay away is usually issued in the beginning stages of the arraignment and can only be issued by a judge....usually after a couple court appearances, the stay away is lowered to a refrain from at the victims request, such as if both parties are living together..... orders of protection can be issued to any victim, doesnt have to just be domestic related....if a neighbor beats you up and charges are filed, the judge will issue a stay away from op. they can also only be lowered or dismissed by the judge, just because charges may have been dropped, doesnt meant the op is.

No contact pretty much means that if your both at walmart you don't have to leave you just cant say anything to eachother and stuff like that I deal with it all the time because of my brother and his girlfriend
