How can i do a statement?

How can i guarantee that the police will keep their promise of no charges if i write a confession statement?

  • i was brought into an interrogation a few days ago for a case of vandalism at a school. i do not attend this school. the school constable brought me in for interrogation and placed me under arrest. during this interrogation, he said that if i write a confession statement to him, he will require restitutions for the damage done but will not press charges. i refused to write this statement because i know that if i write this confession statement, he can deny his promise in court and use this statement against me. how can i prevent this from happening if i decide to write the statement? can the constable write a statement stating this promise that i can bring up in court if he decides to press charges? can i have a witness in the room while the constable makes his promise that i can bring up in court? if i write on my confession statement that "i am writing this police statement only under the conditions that the constable has promised me no charges in return for my confession", will that make the statement invalid if the constable decides to bring it up in court? will a combination of any of the above work? or am i totally screwed regardless if i agree to write this statement? thanks!

    He does not have the power to make that promise. The DA or prosecuting attorney decides whether or not to press charges not the constable. So never write a confession.

have your lawyer make an out of court settlement based on what you just said. that way you won't even go to court. by the way,--did he read your rights when he arrested you and how old are you? if you are under age they can't ask you anything at all without your parents being there. if he didn't read your rights then you go scott free

My friend if I were you I would say fine and offer to write the statement. However, I would definitely have a lawyer present while all of this wrangling is going on about charges and statements. The lawyer will be there to protect your best interests and will make sure you are not totally screwed. If this is in the US and the Officer has already arrested you then that means he has developed some sort of probable cause that you committed the crime. So that means he has some sort of proof to use against you in court already. This statement thing may be a road out. Definitely speak with a lawyer.

Why would they not press charges IF THEY HAVE A CONFESSION? They have nothing on you. Resist.

Tell them you want that promise recored in writing or by your court appointed attorny. I just re-read your story, tell the constable to F*ck himself and have the cops come in and arrest you. If he had enough evidence you would be arrested, since you are not he is trying to get you to confess so it saves him a head ach. Tell him you are not going to talk to him, tell him to let you go or call the police. If he does not you will file a police report for false imprisonment with the local authorities and he will have to answer to them. Unless he has witnesses, he has nothing. If the witnesses are your friends tell them to keep there mouths close.
