Can your probation officer violate you for not showing up when you're in the hospital?
-
i have a friend that was in the hospital so he couldn't meet his probation officer when he was supposed to,he notified the guy..did everything he was supposed to, the guy violates him and now he's in jail for violation of probation, that just isn't right.it's not his fault he was in the hospital and florida does this to people to keep them in the system and charge them more money.can't we notify someone that this probation officer knew about this and still violated him, just because he's on probation doesn't mean he doesn't have rights, and it all comes back to one thing. they want u paying more money.

Answer:
Blah blah blah. Your friend is lying to you. Or maybe you are the "friend." and you're lying here.

It seems unreasonable of the PO to arrest the guy IF he REALLY gave notice to the PO. If this person has missed appts before, the PO may be fed up with 'excuses', legitimate or not. There are supposed to be checks and balances in the US, such as reporting issues like this to the State Dept of Justice, but you can't count on the supposed "checks and balances" of the U.S.
your friend is to notify the probation officer about going to the hospital, however if it is an emergancy and he needed medical transport from and ambulance, and he has proof of that, and proof that he did tell the probation officer of what happened and how he ended up in the hospital and why, and cannot leave for x amount of days and give notes as well as tells the officer to visit him in the hospital, and notified the hospital about him being on poroll then he should be clear and not face prision time, I would go and get a lawer to get the guy out of there and back on poroll because that is an abuse of the porollies rights but go to a lawer first and explain everything, I am not sure about flordia law
Wow, I find that very hard to believe. Is their more to this story. If he was in the hospital and he let his P.O. know about why he was unable to go prior to his appointyment. If that is the whole story I would go to the P.O. supervisor and explain his situation and respectfully ask he be released. If he not be released I would seek civil action against the P.O. Just the fact that the P.O will have to go through the civil litigation he may think twice before he push that plastic badge around. The norm is he would just have to report after getting out of the hospital and show proof.
actually you are wrong being on probation means he has LESS rights... yes they can violate him.. did he get written permission to go in the hospital and make arrangements for his appointments?! Notifying someone you are going to the hospital and getting PERMISSION to do so are VERY VERY different and po's are notoriously aholes about people on parole thinking they are free. in short YES HE CAN
Yes he can. Obviously since he did
