Is misdemeanor Pety Larceny a serious probation violation in Nevada?

  • Im 20 years old and I am currently living in Las Vegas, Nevada. I have been here sense January 2010. Here is my situation, back in January I was living in Arizona and was arrested with the guy I was dating at the time and charged and convicted of Solicitation to Commit Burglary, I was sentenced Feb, 8th 2010 to 2 years Supervised Probation with a suspended sentence of 6mo-12months, the charge was considered a Class 6 Undesignated Felony, which in Arizona means upon completion of Probation successfully it will be on my record as a Misdemeanor. The AZ court granted me permission to do Interstate Compact with Nevada so I could move to Las Vegas and serve my probation here. May 24th, 2010 I was arrested by my probation officer for failing a drug test. He put me in CCDC where he then sent my violation papers to Arizona and waited for their response. Two weeks later AZ responded to release me and give me another chance. When I got out I received a letter from AZ stating if I have another violation I will be ordered to return to Arizona to complete the remainder of my probation. Just Yesterday on July 10, 2010 I was at the Meadows Mall in Las Vegas and was cited with a Pety Larceny misdemeanor ticket, the cop who wrote my ticket knew I was on probation and said it was up to my Probation officer to violate me or not. He also said I am supposed to tell my P.O. about the incident. I have a court date at municipal court on September 3rd 2010. Unfortunately i am planning to move back to Arizona by August 1st to start school full time i am already enrolled. I was wondering if anyone knows what would happen if i did not tell my probation officer and just went and took care of it without his knowledge and still moved to AZ like i planned. Cuz in the system it says im on probation out of Arizona.. so they might not even know that i have a p.o. here . Also what would happen if i did tell my probation officer, would it be like the last violation where he arrests me and waits for Arizona's response? also is this considered commiting another crime and is my probation at serious risk for being revoked by AZ and me having to go to my 6-12months? i am also wondering if this court date will have a judge or is it just a window i go up to pay a fine? I would really appreciate if someone could let me know what to expect from my different options and if anyone thinks i will need counsel, thank you so much for your time i know this was long! p.s. PLEASE NOBODY RESPOND SAYING MEAN POINTLESS UNHELPFUL THINGS ABOUT MY PAST MISTAKES, I ONLY WANT TO KNOW WHAT I CAN DO ABOUT MY SITUATION FROM THIS POINT FORWARD, THANK YOU

    I'm not going to read that whole, long, sordid explanation, so I'll just answer based on the subject. Yes. ANY crime while you're on probation sis serious and should be landing you in jail.

Point blank: you are going to jail for six - twelve months in Arizona minimum. I say minimum because after Arizona makes you do the time that they already told you twice that they will make you do, they are going to send you back to Nevada to face the petty larceny charge there. Since you did an interstate compact on the probation, it's possible that Arizona will allow you to do your time in Nevada - which you would do in the Clark County Detention Facility since you wouldn't have enough time to do to be sent to the state prison. As far as telling your PO, that's your call. If you tell him and make a very good excuse up, there's a possibility he'd work with you to keep you out of jail. If you do not tell him, he will come arrest you and take you directly to the CCDC. (He reads the arrest docket every morning and already knows you were cited for theft.) The PO is not a stranger to the criminal justice system, and there is a good level of communication going on between the courts and the police and probation departments.
