What can i do if a shop owner has my equipment locked in her shop?
-
I have been working at a tattoo shop for the past month. In that time, the shop has been closed unexpectedly three times. The owner has given me little or no warning each time this has occurred. Last week, the shop owner's mother in law died. She claimed she texted me saying she would be out of town for the week, but I never got it. Nevertheless, She called me monday, and said she was back in town. I went in on tuesday. I wanted to take my equipment with me, but it was raining and it is awkward to carry on public transportation. Before I left, I asked her if she would be there today, and she said "yes". I go out there today and the shop is closed. I called her cell phone and it says I dialed the wrong code or number. Called several times , did the same thing. I called the shop phone and left her a message saying call me because I need to get my stuff and leave for good. My question is what can I legally do to get my equipment if she does not respond in a timely manner? I have a tattoo to do tomorrow outside of the shop and I need to get my stuff before tomorrow evening. I was thinking I could call the police non emergency number, call a locksmith, have them open the door and have the police escort me in to get my supplies & bill the locksmith's services to the owner. Any help would be appreciated.

Answer:
I have no guesses about what rights you have to forcibly enter the shop. If you are an employee, you have no right to do that. If you are a partner, you have every right. If you are a contractor, read your contract. No locksmith is going to get you in without proof of your right.

not sure there is much you can do, i doubt the police could help unless you have proof the items you would be removing are yours... i suggest in the future you take your equipment home with you int he evenings
Call the cops, they can advice you on what steps to take or they can contact the owner to open the shop for you.
I'm not sure the police can help, you may need to contact an attorney. One thing for sure though, there is no way a locksmith will open the shop for anyone other than the owner.
A locksmith won't open the door without proper proof you own the property. A brick to the window sounds like a good idea to me.
