When does it become self defense?
-
so i was just watching a video on military.com about this guy teaching how to do the hammer fist, and its talking like you wanna do it when hes first talking about how hes about to beat you up sideways. and its supposed to knock them clear out if you do it right. but what if i hit them, and it kills them, via breaking their neck or something? is it self defense? or murder? considering they're mid saying"OH HAHA BUDDY, REMEMBER THAT DAY AT SCHOOL? IM ABOUT TO KICK YOUR.." and you hit them somewhere between remember and your... is it still self defense? even if there is no witnesses? what if im in a parking lot, at night, and i knock him out, or kill him? and then theres really no one to see?

Answer:
You're not going to be able to kill him. You won't even be able to hit him properly. You are untrained and learned it from a video. Enjoy the *** kicking.

All those tapes are just for kids to believe that they could do that .. its never the same in real life.. your best defence .. is your two legs too run ....
Self defense is guarding yourself with equal or slightly greater force. For example, if someone is holding a gun to your head, you have the right to kill them and it will pass for self defense. However, if something like the first scenario happens, it will be manslaughter, accidental killing, or first degree murder if you break their neck.. If its the second scenario, knocking him out would be assault and killing him would be first degree murder. If there is no one to see the police will have to get evidence on the assault- a bruise, broken bone, or something like that. Even if there is no one to see, it is still self defense. That video you saw, that's assault. Hope this helps.
If you hit them first, then any claim of self-defense is gone out the window. If you kill them, then you are going to be in a great deal of trouble. When in doubt, leave the area. While some idiots around there might make fun of you, none of them will be serving your time when you are arrested and convicted of manslaughter or involuntary murder.
