Can you use recordings accidentally made as evidence?

  • If someone had a recorded meeting in hotel conference room and forgot their recorder but when they found it contained a shocking crime could it be used in Ohio?

    in most states I know, at least one person involved in the conversation must be aware the conversation is being recorded. This prevents a third party from recording info to use as evidence. so, i don't think it will be admissible as it's a third party recording technically

If joe citizen turns over the recording to the police it can be used all over to get such things as a search warrant. Using it directly in court depends on the state. Illinois definitely no. Indiana and Florida, yes. Don't know laws or court decisions in other states to comment.
