What are the chances of winning a seat belt ticket in Oregon? ?

Ok, well the other night i was driving to get my friend in eugene because he was lost, it was about 2:30am, so i had to go meet him somewhere and he had to follow me to my house. We stopped by 7/11 to grab something to eat, i get back in my car and the automatic seat belt doesn't slide back over and secure, it just stays right in front of me, and my lap belt didn't work at the time, it wouldn't latch in, so I'm on my way home and a cop pulls me over for not staying in my lane, when i used a blinker to get over... he sees I'm not wearing either of my seat belts and write me a citation for "failure to use safety belt (lap & shld) (auto)" this is my second seat belt ticket, after my first seat belt ticket i took my car to Nissan to get my seat belts repaired, and they failed to do so, so this will be the second time I'm taking my car back to get the seat belts repaired. This was a malfunction, am i able to fight this? if i get this ticket i lose my license for 6 months.... I've had 1 speeding ticket, 1 seat belts ticket, and now another seat belt ticket.. is there any options for traffic school to drop the ticket if i lose?

you are responsible for a working seat belt. If it cannot be fixed, you will have to junk the car. You have zero chance to win the ticket.

You say you took it in for repairs and they didn't fix it correctly. How long ago did you take it in for repairs? Have you followed up with the dealership? Did the dealership give you the run around? How hard have you been trying to get this resolved? Was it working when it left the dealership? How long before the ticket did your car start malfunctioning? It will really depend on these factors. Remember judges aren't required to convict you of a crime and yank your license, there is a certain amount of discretion that a judge has, and a good judge will listen to common sense. If common sense is not on your side, you'll have to deal with the consequences of your actions. If common sense really is on your side, then you have a case, as long as you come across as sincere, honest, and not frivolous about it.
