How can I win a ticket for not intentionally trying to take a short cut from a store parking lot?
-
I entered through a parking lot as I intended to shop at the store by which I did see a police car with the cop in it.However I changed my mind as I realized I did not have my coupons to shop.I thought to the next grocery store by getting out of this parking lot onto the public street hoping to make a immediate right turn into the parking lot of another grocery store.Again I changed my mind not to shop after reading sale prices on the street board.I knew there was a cop and he would think that i tried to take a short cut but I honestly changed my mind as i was driving. The cop followed me and issued me a ticket.I shop those stores regularly.I also was going on that route to shop as i take a different route everyday to come home.My intention was not to avoid traffic or take shortcut.I also tried to rattle off the sale prices of the grocery store items but I cop still did not believe and asked me to fight in court. He cannot read my mind. Also, I accidently gave him the expired proof of insurance and he tells me this after I got ticket. I immediately found a valid one but he decided not to see and told me to come in court. Now I am going to be fined for 2 civil infractions (taking shortcuts and no proof of insurance) and receive violation when i did not intend to do any wrong? How should I defend and win this ticket.

Answer:
The officer should have reviewed your new insurance card and marked through and initialed that particular violation. As far as the other charge, thats up to the judge to decide.

If you show that you had valid insurance, they'll probably drop that one. As for the shortcut, your intent doesn't matter. If what you did was a traffic violation, sale prices and coupons don't enter into it.

Nice story. If you bring the proof of insurance, that citation will be dismissed. As far as the other................Pay your fine............

your best option is to fight this ticket by pleading not guilty to both infractions. You will need to bring proof of insurance that was active at the time you were pulled over. Secondly, if you were honestly not seeking a short-cut to avoid a traffic light, explain your situation to the judge. Give the judge the details of how you realized you had forgotten your coupons. Always remember that cops pull over many citizens each day, so the officer will not likely remember all of the details regarding your ticket. Generally judges give more clout to officers, but if you explain your situation in a calm and thorough manner, your side will be heard. Police officers have to write tickets because they have financial obligations to the districts they serve. Even if the police officer thought you were right, he/she often writes the ticket in hopes that you will just send in the check or plead no contest and pay the fines. Your best scenario would be that the day of your hearing the officer does not show up. If your accuser is not present, you can tell the prosecutor that you move for dismissal because the officer is not present. The prosecutor will attempt to get you to plea bargain, because they will want to salvage some of the ticket moneys. Do not plea bargain. Remember to have your proof of insurance in hand and that specific issue will be dismissed right away. Keep hoping the officer is busy the day of your hearing! I hope this helps...

It doesn't matter what you intended to do it's what you did do. And you did violate the law. Once the ticket is written there is nothing the officer can do. And I'm guessing if you communicate as poorly verbally as you do in writing he probably didn't have a clue as to what you were trying to say.

I find your insurance story hard to believe. I was stopped once and showed an expired insurance card and a receipt for renewal that is not legal proof of insurance. The officers accepted that. As long as you can show you were legally insured, that ticket should be dropped.

Yea, I'd try telling that story to the judge. I'm sure it will go over real big. Make sure and take enough money to pay the fine.

First, have proof that you did have valid insurance but you just got frazzled and showed an expired one. I probably have cards from 2004 in my purse. I don't know why. Then just explain you are on a budget, you shop carefully and check sales first. You forgot your coupons and the sales weren't good enough for you to go without them. I think this is one time you can win.
