How do I get out of my talent agency's contract?
-
So in the beginning I thought it would be a lot of fun! You know modeling and that stuff. This was oh lets say 5 years ago.Well, I never got called. Maybe twice for the five years and they were for bra modeling when i was 7 (NO) and a "family" hooters commericail audition (NO!!!!) Every year my parents have to pay 100 dollars for me to be in it. It's a small agency where their are two "agents" and they are the managers. I'm an 11 year old girl and my dad's friend is a great actor, he's starring in a movie with Tom Cruise right now! He is CONSTANTLY getting called for auditions! I met his agent and she is VERY nice and Professional :) she said she would love to have me...for FREE! My mom rejected and my dad does what ever my mom does. So, my mom says i can't because im already signed with another "agency" How do I get out of this? PLEASE HELP!

Answer:
Without seeing your contract it's impossible to say. Nobody on Y!A can advise you - you need to get a lawyer to review whatever contract you signed and see if there is any way for you to leave the agency before the contract expires, and if there are any cancellation fees No agency can guarantee you auditions. They can only send out your headshot when there is a casting call for talent in your age range, with your experience level, and with your looks. Then it's all up to the casting director if they want to see you or not. Just because you only got called for 2 auditions doeesn't mean they aren't working. They might have sent out your headshot for 100 jobs but nobody was interested enough to audition you. And what have you been doing about it? You and your parents should have face to face meetings with your agent every few months to discuss your career and what you can do to make yourself more marketable - take more classes, get more amateur experience, work one on one with an acting coach, take dance lessons, get new headshots, change your hair style, etc, etc Also at 11 there are restrictions on the times you can work. A casting director would rather find a young looking 15 year old who can pass for 11 than an actual 11 year old. Why do you think almost every actor on TV playing a high school student is in their 20s? Your parents need to hire a lawyer to review your contract to see if there is any sort of opt-out clause, and if not what sort of penalties you face if you do leave. Most agencies will have some sort of opt-out clause allowing you to leave if they fail to send you out on xx number of auditions within a certain time frame

You are in a very very bad situation because i dont think that you can get out of it...all that you can do is wait until that contract is done...wow that sucks!!!! i hope that it all works out!

clearly you dont know nothing about agents and acting, agents dont give tons auditions is mostly 2-3 a months that are big and depends where you live close or far and if you suit the part if your young they may not be lots of auditions for young girls theres more when your 16 and a teen and you have to have "the look" you have to wait till the agency is done
first if your paying them a fee to find things for you, they aren't legit. legit agents only get paid if you work. i doubt you signed a contract for five years. just tell them you haven't gotten anywhere and want to leave. you haven't made them any money. agents do specific things, they don't do modeling and stuff. if you just have a modeling agent they can't get you on tv or film auditions you need a theatrical and commercial agent for those. you can have more than one agent as long as they don't do the same things in the same place. read your contract, there should have been a time limit on it and you never sign a contract that doesn't give you a way out. never sign a contract for more than 6 mos, maybe a year at the most and always make sure there is something in it to get you out if things aren't working out. just tell them nicely things aren't moving along where you are and you think it's time to move. did your parents ever renew your contract. you might be sitting there without a contract when you could be somewhere else doing something. you probably could have been gone a long time ago. you should have been gone by the end of the first year if you weren't sent out.
