  • So I think I got sexually harassed at work a co worker has been staring at me and my body parts then finally took action and grabbed my wrist twice trying to put me in the corner then stuck his finger in his mouth and his eyes rolling back and sucking his finger I told the supervisor so he took us in his office and basically begged me to not say anything because he was a good employee he gave me too options he told me one tell the front office quote he said he would be very unhappy if I did or two dismiss the case here both of them were in the room so I panicked i said i wud dismiss it he also told me not to tell anyone we talked ,for the past couple days I haven't been myself and there is proof there are cameras in the factory so they recorded it happening, after in the incident I've decided that I wanna sue but I was wondering if you think I would win my case and how much should I sue for?

    Well yes sue them! That's completely out of order. I have no idea what the range you can sue for ( must be alot). But your boss can't know about you telling them, try to get a copy of the tape.

Yeah, this person not only stepped over the line, they passed it and are now on thier way to Nebraska. If you dont want confront this person yourself, go to your supervisor. Tell him/her that what him/her did is still bothering, and upsetting you., Then go and ask the supervisor to call this person into his office and have a quiet word with him/her so he knows the effect its having on your ability to work or concentrate, Tell the supervisor that this has to stop immediately, or you wil have to go to his superiors, and tell him that your supervisor is well aware of the situation and has chosen to do nothing. Try to talk to your supervisor in a relaxed and comprising manner. the best bet is pin a huge smile on your face, when you walk in thier office,, Frist you bring up something banal, like the weather, and then gradually swing the conversation to this troublesome work coleague. Let him know that you are considering exploring legal avenues, this should scrare the crap out of him, but remember, be gentle and inform, Believe me, in matter like this, have to be handled with great sublety. Then if nothing changes either start looking for another job, go find a civil suit lawyer and sue the *** of this guy, the supervisor who knew about it and did nothing and failed to act on an act of sexual harrassment, and of course the company is liable for failure to live up to thier "Duty of Care" legal responsibilities. If none of these approaches appeals to you. Dig out the Blue Pages phone book and look up. Anti discrimination board. You may get some compensation out of too, or if your not out for any cash settlements, make sure you have al letter of apology from not only this guy but your supervisor as well. That way if you do have to leave, and you are happy to leave this experience, you will have those two statements to support you as to why you left your last company, and hopefully they wont bother ringing your former employee, because the boss at your new job, will be ready for thier responce, and hopefully with your suppoting paperwork, he'll ignore what you nasty former manager says. Maybe even approach the anti discrimination board for a letter of support, because if you do go, this supervisor and his superiors are going to trash you as being a "tease" or a too tdisruptive employee, so dont bother hiring you. I had this exact same scenario (except the finger sucking} happen to me, that company managed to find an excuse to make me resign a few weeks later and this company had me blacklisted with all the other companies who did the same sort of specialed laboratory. If you decide to stay you can also expect that your companies HR team will suddenly start teaching "What is sexual harrassment in the workplace" seminars"

Don't sue at all. Litigation is vastly expensive, both in nerves and money. The only winners are the lawyers, who will always tell you to sue, it pays for a new sports car. They're like the doctors who'll tell you to get circumcised to avoid ingrowing toenails when you're 60, or do it to your son, "because it's cleaner" (as though there are no bathrooms and no-one has running water these days anyway); it pays the next instalment on their sports car.
