What tax year is IRS auditing now?

Can I claim irs 8863 (year 2009) in this year tax return 2010?

  • I went to repairer to do the tax return for me last year, but she forgot to claim form 8863 which is education credit. Can I still claim last year education credit for this year (year 2009 and 2010 together in this year tax return)? I'm senor of undergraduate program, I know that I would not be qualified for HOPE anymore(I am more than 2 year in college already), but I know that i am still qualified for life time education credit though. Thanks in advantage

  • Answer:

No, to claim a credit for 2009, you have to amend your 2009 return, not claim it on 2010. You'll claim any 2010 credit you're eligible for on your 2010 return - if you're still in your first FOUR years you might be eligible for the American Opportunity credit.

Other answers

You would amend the 2009 return.

No, each tax year is separate.

First, Do not go back to the preparer. If you still looking for help with your tax return, you need to find a good preparer. Ask around your families and friends for references. Second, No, you will need to amend your 2009 tax returns by filing 1040x, you will need to tell IRS reasons why you are changing your 2009 tax returns. Make sure your reason is as detail as possible. good luck
