Exempt from NY City Incom Tax?

  • I used to live in NYC but have moved to NJ a year ago. However, on my paystub it still takes out amounts for "NY City Income Tax". I was told that tax is only applicable if you are a resident of NY City. I should now already be 'exempt' from that tax. Do I have to file a new employer/allowance withholding form to claim myself exempt from the city income tax withholding? And for my first paycheck in 2009, can I ask my employer to credit that amount back, or do I have to wait until tax filing next year to get that amount back from the city?

Yes you should file a new withholding form with your employer to exempt yourself going forward. Your employer will probably refuse to credit back any 2009 withholding. Assume you are filing for 2008 to get back that refund.
