How long does it approximately take to gain credit?

Long complicated question about homebuyers credit from 2009...?

  • Ok im not sure how to word this if you know nothing about this credit and repayment then you probably should move on ...in 2009 we (my husband and i) purchased a home, HOWEVER AT THAT TIME WE WERE NOT MARRIED i had already filed my taxes and he had not so HIM AND ONLY HIM filed for the first time homebuyers credit, that was the year that they were not requiring pay back for the credit, but of course with anything there was stipulations that we did not know about needless to say we moved a year and half later because of being broken into three times, we legally sold the house back persay to the original owner (land contract) with NO GAIN. Just a few months ago my husband got a letter from irs explaining since it was not his main dwelling and he did not stay for a total of 36 months from purchase date they it would have to be paid back , but there was more information on the form my husband being the responsible one he is has misplaced this and i never really new the depth of it until recently. He is an SSI recipient im the only one that works, and recently filed my taxes, i am due a refund from federal of over 4000 and on the wmr site it says its processing blah blah, i did some research and found out that if you sell and make no profit that you dont have to pay it back but it then says about if you werent married at the time your spouse is not responsible and there are so many different rules and diffferent things, last year we got our refund no problem that also being the year AFTER we sold and had not heard anything about repaying, i looked up the homebuyers credit repayment thing on the irs website and it shows the credit amount he got and then has the message if your spouse did not recieve thier half they need to file and then shows 0 paid to this date im so confused because after reading some things i feel comfortable my refund is safe and then i worry they will take it we did not know about a form called 5405 that your supposed to file the year of the sale meaning that would have needed to be done in 2010 and we got our taxes last year no problem, i called offset and there are not debts attached to our ss #;s but i know irs is different what im wondering is if anyone had any experience with this.

    Your husband has to be pay the money back. He did not live there for 3 years. It doesn't matter if he made $200000 profit, $0 profit, or a loss. The terms of the credit where that you had to pay it back if you did not live there for 3 years. - your refund is probably safe. your husband owes the money.
