If I owe on student loans and I start my own business?

  • If I open a business checking account to start up an online business, will I have to start making payments on unpaid government student loans? I have not had any income for the last three years after my baby was born, and I was seperated from my husband. I would like to start a business to have an income, but if I open a business checking account, I believe the IRS would look at any money put in to my business checking as income, which would possibly take my student loans out of deferrment. It is not that I would hide money from the IRS that I actually do earn as income, but the money I am going to use to open a business checking account is a gift from my parents. Would the IRS see that as revenue?

    You have 2 separate issues. If you start a business and have income, then yes, you have to report it. Net income above $400 must be reported even if you file separately from your husband on an MFS return. (Unless and until you can support yourself, you can't file HOH.) When you have a business, you report the income on a 1040 using schedule C and SE. You will show revenue and expenses, but NOT the gift from your parents. That's called capitalization and isn't taxable. If you are worried about an audit from the IRS, photocopy the check from your parents before you deposit it. Have them write "gift" on the memo line. (If the gift from each parent is more than $13,000, your parent(s) must file gift tax form(s).) Once you have income, it's your responsibility to call the student loan holders and start paying.
