Tax deduction for Legal Fees?

Student fees tax deduction (what year do I take it)?

  • I had student fees that according to: http://www.irs.gov/publications/p970/ch06.html#en_US_publink100020946 are tax deductible. My question is this: I paid my fees for the Winter 2010 quarter (starts in January) in December of 2009. Do I take this deduction in 2010 taxes or 2009 taxes? I paid my Winter 2009 quarter fees in January of 2009. I did not claim this money on my 2008 taxes (obviously). so in 2009 I paid 5 quarters worth of student fees, but one of those was for a quarter that started in 2010. Michael

    You take the detuction in the tax year when they are paid. So the ones that were paid in January 2009 are taken in the 2009 taxes you are about to file.
