Can you claim child support on your taxes?

Can i claim a dependent on my taxes if they are not my child but i provide their support?

  • My aunt (mom's sister) has a child whos is 3 yrs old. The child's parents live in mexico but the little girl was born here. They decided they want a better future for her so they asked me to be her guardian so she can come to school here in california. I have been providing her support and she has been living with me but I do not have any legal documentation that says so. Can I still claim her on my taxes? What if her parents and I get a notarized form saying she will be living me? Would that make a difference?

  • Answer:

Is she your neice, if she is your niece than you can claim her without having any legal documentation, but she must have a SS# to be able to be claimed.

If you dont have any legal documents then no, that will be a red flag for an audit and you don't want that kind of trouble from the IRS
