How did my ex-husband managed to get the whole stimulus check without my permission?

  • Ok, this is what happened. All 2007 I was married to my husband, but 4 months we were together and the remaining 8 months we were separated . So by the end of 2007 we were still married but separated. In all 2007 I only worked for one month on December and made only 600 dlls so I didn't have to do my taxes, since I didn't owe to the government (Actually the government was supposed to give me a little but I didn't ask for it) I am fairly new to this country so I had no idea their was a stimulus payment going on. My ex did his taxes for 2007 as if married to me (because we were married even though we were separated so it is ok) but I am not sure how he got the stimulus check that belonged to me and his (600 dlls for him and 600 dlls for me) unless he filled "married jointly" but we didn't do it together. He needed to file "married separate" didn't he? Was people able to get the whole stimulus check that corresponds to their partners even though they didn't file together? Did he had to file "married separate" or did he signed for me without me knowing, or using my social security without my knowledge? If so would that be fraud? This year I realized this because if you did get the money for 2007 then you cannot ask anything for 2008, so I asked him if he had gotten all the money for 2007 ($1200) and he said yes.

    He would have had to sign your name on any tax papers if they where filed jointly and the stimulus checks where issued based on those tax returns. hey also direct deposited most of these stimulus checks so that is most likely how he was able to get it. You need to find out if your signature was forged and if there are any bank accounts and stuff with your name on it still to protect yourself

The only thing you could really do is go ahead and file a 2007 married separate. Then the IRS will start asking questions.

The thing is, to recieve it, you must of worked and made a specific amount of money and you did not. You do not deserve it, its by income. The thing is, he is a life long tax payer correct, and you state you are new to the US, so you have not contributed to this economy tax wise that much right? If you were legally seperated, as in by court decree, he should of selected married but seperated, but a tax rep would know better. If you filed seperately, he would get 600.00 max, and you would of gotten nothing at all, you did not make the proper amout of money. So why care about this? If you now file your taxes, and I suggest that you do, it shows a starting point of you being responsible for yourself, you will not get the stimulous, you will get more protection if your ex ever owed them taxes during your marriage or whatever. If you are simply not living together, there is no court ruling saying you are seperate, and all debts are yours to share together until the day you seperate. Its worth paying someone to help you do your taxes, and understand all the legalities of the USs income rules and how divorces go and everything.
