What do i say to keep my EDD CA unemployment benefits after my part time employer reported my wages?

  • OK so I'm receiving benefits from edd BUT i was working on the side part time for about 4 months i made about 2500 in that time frame. i worked there about 3 years ago and they called me back so i made the mistake of not reporting my wages to edd because I really needed the money I am barley getting by on the edd benefits but now edd wants to do a phone interview tomorrow because the employer reported my wages and edd found out. They put my benefits on hold. I need help, what do i say to them so i can keep my benefits? I just had a baby and i need the benefits more then ever now. please help!

    With 4 months of fraudulent claims on your record -- EDD is going to throw every one of those certifications in your face where you swore that you made no income -- the best result will be that the state decides to not prosecute you for benefits fraud. They will very likely rule your entire claim as fraudulent and demand that you repay ALL of your previously received benefits in exchange for not prosecuting you. You really need to contact an attorney. Depending upon the amounts involved, you may be looking at felony charges. Here's the real kick in the teeth: Had you reported the part-time income properly, you may have been able to keep some or even ALL of your UI benefits! Since you made a conscious decision to file fraudulent claims you've pretty much hung yourself out to dry now.

Sorry, but you are technically cheating the taxpayers. If you cannot afford to have your kid try welfare, but UNEMPLOYMENT is not for the employed. This is why CA's unemployment system is so messed up....we have people who become addicted to the handouts.

Oops, I screwed up. There really isn't anything else you can say. You got caught. They will make you pay back the benefits you received that you were not entitled to and you might run into additional problems.

There's nothing you can say to keep the benefits you've been collecting fraudulently. You'll have to pay them back. If you're very lucky you won't be prosecuted and sent to prison for unemployment fraud.

Your best advice is to buck up and be honest. You tried to game the system and it's coming back to bite you. Be honest in the phone interview or you'll probably end up worse off. "What do I say?" indicates you're looking for something other than the truth in an attempt to fool the administrator.
