Will I be eligible to collect unemployment benefits?

If I collect from my anunity while on NY State unemployment benefits will that affect my unemployment?

  • Do I have to declare this as income? I am in NY state If yes, then I ask this: my annunity payments will be every 2 weeks. On the "off" week can I collect NY unemployment as technically I won't have any annunity check that week. Thanks

    The only income that you must declare is income from wages or self-employment. Taking an annuity distribution has no affect on your UI benefits and you do not report it.

It is income but not earned income and has no effect on unemployment which only deals with earned income

This would NOT be income from working as a employee or self employment income for working performing your services to receive any type of earned income for this purpose BUT you can verify this information with your UI office at this time in your life to make sure that you do get this done correctly for this purpose in your life. Just make sure that you do contact the UI and get it done correctly be smart about this matter and do not drag your feet just get it done NOW ASAP and quit wasting your time. I am sure you have to claim it as income but it is not earned income on which your unemployment is based

Seriously? Since you get that check biweekly, why not just complain that you don't get checks for the other 13 days? Yes, you have to declare income or that's fraud and you have to pay it back. They can garnish your annuity payments.
