Questions regarding problems with IRS refund following a name change?

  • I legally changed my name last February (2/11) and within a month I had everything from my ID, social security card, bank accounts, and my payroll at work updated. Last year I filed under my previous name, and this year I filed under my new name. All of my W-2 forms matched up and it was accepted by the IRS early February. I was given an expected date of 3/6 for my tax refund, and nothing came to fruition. Today I contacted the IRS to find that they only had my old name associated with my social security number in their database, and that it probably was not changed with the social security administration. I called them to verify this and was told that yes, it was changed to fit my new name (something I already knew though common sense as one can't get their name changed on payroll without the social security administration recognizing it) and that there shouldn't have been a problem with the IRS recognizing it. I have now been told it will be an additional eight weeks before I get it. I desperately need this money and I feel this delay is ridiculous considering I had my named changed on everything a full year ago. This leads to my questions. Is there a specific department or entity within the IRS that deals with name mismatches in tax returns? If so, who are they and how can I get ahold of them? I have all the documents I need to prove my identity and can fax/mail them if necessary to expedite the process. I've waited nearly a month already and can't afford to wait for two more months.

There is no department within the IRS that deals specifically with your above mentioned issue. There must be something more to this story... Did your W2 have your new or old last name? If you are in that great of a hardship, you can always contact the IRS Tax Advocate service. However, because Im dealing with ID theft and was told also to wait 8-12 weeks, I did contact a tax advocate and from what the rep told me, this may not be your best option. First, you have to show physical proof that there is indeed a hardship that you are going to incur due to this delay... Such as, a medical need, utilities being shut off, eviction. None of this is a personal issue for me so I didn't qualify for their services anyway. In any case, the advocate advised me that in MOST cases, you would have already received your refund from the IRS in the time it would take an advocate to intercept it. Ive already waited 6 out of the 8-12 weeks quoted to me. Goes by faster than you think. Good luck and hope it all works out for you. Tro: that's both true and false. While the tax advocates don't handle delays in processing, they do however, handle delays in refunds to people who have issues with their returns. Please don't give out false information.

if you follow this forum, just about 90 % of the posters are looking for their refunds yours is no exception and hard as it may be to accept, you will simply have to wait, nothing will speed up the process, and Tax Advocate is there to resolve issues that have not been resolved, a refund delay is not that!
