Can i claim my son at the end of the year when everyone gets their tax returns?

ok i dont know much about this. my son will be eight mounths old in november. i babysit two other children through the week so i can make money and be home with my son at the sametime. but when i babysit i get paid in cash. i was wondering if there was some type of paper that the parents of the children i watch could fillout saying how much i make n how many hours a week i watch them so i can get child credit when the tax returns go out. someone told me that you could do this and im not sure how and really could use the help. and another thing, if the question above is not possible i was wondering another thing. My sons father and i have been together for 2 years. we go through our ups and downs and i never know if we will break up. thats why i want to claim our son and not have him do it because if we break up i will be suporting my son off my babysitting job with no help. if i alowed him to claim him he said he would sign a contract saying that he would give me all the money that he would get for our son, is that legal?

You are LEGALLY REQUIRED to report your babysitting income on a tax return, and pay tax on it. If you and his dad have both lived with him since he was born, the parent with the higher income can claim him unless that parent agrees to let the other parent claim him.. If his dad claims him, the two of you canlegally make any agreement you want to on how to split the money. The IRS won't enforce it though - you'd have to sue him for the money if he didn't give it to you.

It is your responsibility to keep track of how much you are paid. You are the one that gives the receipts to your clients. How much did you earn? Does your boyfriend live with you? If he does he may be more entitled to claim the child then you are. If he is entitled then it is not up to you to give him permission. If he lives with you and has a higher income, he wins the tie-breaker to claim the child on his taxes and does NOT have to clear this with you, nor does he have to share the money. If he makes less than you, you win. If he makes more and agrees not to file, you can claim the child. If he doesn't live you, he has no rights unless you sign a form 8332. Next, babysitting in your home is taxable income to you. If you made more than $400, you must file and pay the 13.3% self-employment tax. if your income is more than $9500, you will also owe income tax. If you are able to claim EIC and the Additional Child Tax credit such that you get a refund, you MUST be able to prove you had the income. This will be difficult if you have been accepting only cash and haven't been depositing that money directly into a bank account before spending it. first of all, the parent with whom the child spends the majority 'nites' with claims the child, and this child was born well before the Dec. 31, deadline and is a dependent for 2011 then to your baby sitting money, this needs to be reported on a sch C and probably SE as well, let's hope you kept good records of your income so you can complete those forms if you qualify for the child's dependency(noted above) you file head of household and since the Sch C is earned income you are entitle to EIC as well you can find these forms(previous years, 2011 is not ready) at www.irs.gov as well as publication 17 which should help you don't count and any ''papers' you might have him sign they won't be worth the cost of the paper one side light if there is a problem determining which parent has the majority 'nites', the parent with the higher income claims the child
i agree mostly with TAX LADY it does depend whether or not the baby daddy lives with you or not and who makes more money, seeing that you work for your self and get paid cash there is no paper trail as to whether you have this business or not. so if he lives with you then your only bet is to do as was said in a previous answer have the parents of the kids you baby sit vouch for you in that how much they pay you their names ssn ( this is for when the parents file their own returns and want to put down that they pay for their child to be baby sat, they can receive a deduction towards their income bla bla) and it would help to have a notary of republic stamp it. but at the end of the day it would be kind of a hassle bc if you work out the numbers your self and you realize you are not making as much money as the babys father you have no choice as to whether or not you get anyone of that money. and also that contract i believe actually would not work out but im not exactly sure because usually in a contract it cant be one sided or it becomes voidable. anyway best of luck sorry for the essay
