I need to take off birth father's name off birth certificate..?

I need to take off my ex's name off my child's birth certificate...Husband want to legally adopt. *** Details: I got pregnant at 17... my boyfriend (child's father) broke it off with me when I was 5 mths pregnant with a little girl and when the baby was born he didn't show up when it was time to sign the birth certificate and later asked for a DNA test... and of coarse it came back a match ...and later went to court to put his name on the birth certificate, because he assured me he has going to be there for us regardless of your broken relationship... court ordered that he had the baby on the weekends and alternate holidays, and he had to pay child support... but since he never helped me financially and he started using drugs and jailed because of it a few times I didn't allow him to see my daughter since she was 10 months....He took me to court again because i refused to let him see her but my lawyer presented the case against him with all the arrests and drug use evidence and the judge through the case out, I haven't heard from him since...my daughter is now 6 and I since have married the guy i began dating when she was 7 mths old and she's our only child... My daughter since she knew how to talk has called him daddy and my husband has always taken full responsibility ...both emotional and financially with my daughter... We've been legally married for almost 3 yrs and he's always said he wants to legally make her his daughter but we haven't been well off financially because of the economy..and i don't know how to go about doing it... what papers i need to feel out...about how much will it cost so we can finally prepare for it....

Answer:
A birth certificate is a legal document of a child's birth - if your ex is the child's father, you can't have his name removed.

He may give up his rights and therefore his responsibility to pay child support. Then your husband can adopt her. The name's not coming off the birth certificate though.
your childs real father needs to sign away his rights.also you should keep her real fathers family in her lifeb ecause she deserves to know them (if they are in her life or wnt to be)
When your husband adopts the child, an amended birth certificate will be issued with your husband's name. You will need a family lawyer. The cost is typically $2,500 to $4,000 depending on the lawyer. That does not usually include the homestudy or background check costs. Keep in mind that you will need the father to sign off on the adoption. A judge isn't going to automatically eliminate his rights, even with jail time and no child support because they are going to look at what he's doing now, not 5 years ago.
