How can I get physical custody of my daughter?

How can we get custody of his daughter back?

  • About 3 years ago my boyfriend lost custody of his daughter then 2yrs old ,now she is 5.her mother refuses to have any contact with us other than his mother.we would love to get some type of custody of her back as we now have our own place (he was vertually homeless at the time and had no way to get to court appointed parenting classes so he was given an hour a week at least/or at the will of the custodial parent(the beast) if anyone knows what steps we should take without involving child protective services I would love the advice. Thanks!

    Paying child support doesn't equal visitation rights. Especial if rights were taken away. Must go through proper channels. The courts and CPS. They are there for a reason. To protect the child. Besides, you want to go through those steps to show/prove yourself. It will look better. You'll better your chances at getting time with the child. You should do everything right. Go the extra mile.

Once you have confirmed she has been served you will be given a court date. The court date has to be mailed to the mother then you have to show the court that you sent it. All he has to do is prove stability and prove that he is not a danger to the child. Its pretty much illegal to deprive a documented parent from the child.

If he pays child support he should be able to see his daughter.

I find that the girlfriend often mends into these affairs. It's up to the mother and father to sort these things out. If the mother has full custody, there must be a reason.
