If my brother puts his name on a child's birth certificate and the baby isn't his can he later on take it off?

...a "Birth Certificate" is a legal and final document... If he signs on as the father... He certifies himself as the father... the only way to remove his name from the certificate at some future date would be to the Court that has jurisdiction over that area and file a motion to vacate... a Judge would review the motion and "if" K could show that he was NOT the father, then, after the Court review, could his name be removed.

If your brother and that chick dont work out he will be paying child support!!! why not take the deadbeat dad for all he has got and file for child support? that way your brother and girlfriend may be more financially stable

They should put the actual father's name on the birth certificate. It'll save confusion later. Besides, the father should pay child support, it's his kid. Not your brother.

You do not have to put the father's name on the certificate. But by doing that or not putting the correct father's name,could lead to all sorts of crap,not to mention not being able to get support from the actual father. ALL the mother has to do is put the real father's name on the certificate and if the paternity test comes up that he is,he is legally obligated to help. AND no,once his name is on it,it's on it.

no he can not and he can be made to pay child support should anything happen to his relationship with momma he better be real careful what he does it could cost him the next 18 years of his life if it goes wrong

i really dont think putting his name on the birth cert is a good idea, if he is putting his name on it and telling the child that he is its father i think it would be very cruel to the child to one day just say "sorry, im not actualy your dad...bye" but to answer your question, yes he can take his name off as he has no biological responcibilities to that child but its wouldnt be easy, he would have to do some blood work and then go through court... its not a good idea

Its nice your brother wants to do this but I don't think he should put his name on the birth certificate because the court will make him responsible for the care of the child regardless whether he is the father or not. (child support etc.) Later on it will become a unnecessary problem and will be very stressful especially if he doesn't plan on staying around. It also wouldn't be fair to the child to have the person known as his father snatched away it will cause harmful emotional damage.
