Child support question regarding medical expenses--OHIO?

  • My daughter's father has never paid any medical expenses of hers, ever, in the last 13 years. I have really never pushed this issue, but now I feel like he needs to start stepping up to the plate and help me with her medical expenses. We do have a child support order through Montgomery County, Ohio, which states that he is obligated to pay 54% of all outstanding medical, dental, and optical expenses. I have two questions I am hoping someone could help me with: 1) How do I force him to pay his portion? Can I sue him if he doesn't or do I have to let the Support Enforcement Agency know and they deal with it? 2) Can I sue him for any previous years' medical bills? I have records that go all the way back to 2005, which add up to thousands and thousands of dollars. I don't want to be an *** to him, but I am tired of carrying the burden by myself. Plus, I guess I am ticked off that he had the audacity to send me a bill that was in his name (not my name) for the amount of $2400. I think this was the straw that broke the camel's back for me. Thank you for your help.

    You are not the @ss, he is. Yes, take it to court. He owes you some money, and he owes your child the father she deserves and never asked for in the first place.

My sister resides in Wyoming. Her husband is required to pay half of any out of pocket medical expenses for their children. She has to go to court once a year to get a judgment against him for the unpaid balance. It will be interesting to see how it goes this year as in previous years the judge has awarded her the equity he still held in the house -- that ran out last year.
