H2B visa to tourist visa?

  • I am H2B guest worker. My visa is expiring in November. Is it possible to apply for tourist one and than back to h2b visa?

    You can apply for a B2 tourist visa providing you plan on being a tourist, not a worker, during that time frame. You will need to explain in a letter accompanying your application your reason for wanting to be a tourist. It will not work if you say you are just waiting for an H2B job offer to come along. So if you really want to be a tourist and see parts of the USA, visit friends and spend money being here, have money already in the bank to support yourself, and not work during the B2 tourist visa, you can apply. But USCIS is strict about your reasons for transferring H2Bs to B2. Still no guarantee that you will receive the B2 tourist visa. I know some workers who have done this, but only because they wanted to visit relatives or places in the USA before going home.
