American father, American son. How to bring Indonesian wife/mother to the US?

  • I am an American citizen by birth. I moved to Indonesia and married an Indonesian woman. Together we have a 6-year-old son who was born in Indonesia. He is an American citizen by virtue of my American citizenship. I want to get a visa for my wife so I can bring her and my child back to the US. Our future plans are uncertain whether we will stay in the US or return to Indonesia in 6-9 months. I just want to find the easiest way to get a visa for my wife so she can travel with us? I hope I can make adjustments to her visa as we firm up future plans (ie, whether to stay in the US or return to Indonesia). I am baffled by all the various types of visas available. It appears, from what I read, that an immigration visa may be the one visa with the least pitfalls, but does this take a long time to process? Logically, I would think the government would want to issue a tourist visa. But that carries a burden of proof that she has a compelling reason to return to Indonesia. From what I hear, that can be very difficult to prove and the visa is often denied. I have a reliable retirement income of $3200 per month. Plus, I have liquid assets worth about $200,000. We own community property land in Indonesia worth about $250,000. Currently I do not have a house in the US. I would need to rent or buy. I have a daughter in the US who has a company with substantial assets. This company could "hire" my wife if that were a good option. Would it be necessary/ helpful if I hired one of the Immigration attorneys I see advertised on the Internet. I hope someone can give me guidance on the best way to proceed.     You will need to consider your plans more carefully. You have the options of either going for up to 6 months. Your wife can try to get a tourist visa for up to 6 months. This option is cheap (about $140 for the visa) and has the potential problem that the immigration officers may not believe she will leave within half a year as her family is with her and they might think you try to get her permanently into the US with avoiding going the greencard route. Maybe if you explain your plans it would work, but you'll have to be rather convincing that the whole family is planning to return. You can sponsor her for a greencard. This will take about 6-9 months and cost about $2000. If you end up staying in the US this is definitely the preferred way. But if you move back to Indonesia she will lose her greencard if she stays out for more than 1 year (or two years with applying for a reentry permit). So a waste of money and effort if you don't stay. You daughter can hire your wife if your wife has the required qualifications for the job and your daughter can prove that she can't find an US citizen suitable for the job (called labor certification and requires to advertise the job for a certain time in certain places). Unless your wife has a suitable degree it's not very likely to happen. But if she has, that would be an option. They also have to pay her prevailing wage. That would be best suited to the lets just check this out option, would be most flexbile.

It is not likely that a visitor visa would be issued under your circumstances. Since you reside in Indonesia, you can petition for her immigrant visa at the US embassy in Jakarta.
