In relevant part, section 505 provides that: Notwithstanding any other provision of law, an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State (or a political subdivision) for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit (in no less an amount, duration, and scope) without regard to whether the citizen or national is such a resident. Under U.S. law, illegal aliens may not hold any job in the United States. Thus, tax dollars expended on higher education illegal aliens to prepare them for professional careers serves only to draw more illegal aliens to those states offering in-state tuition. When an illegal alien is granted in-state tuition and admission to a state university, he or she is directly competing with American students for that educational slot. This competition is unfairly biased against American students in other states who must pay out-of-state tuition to attend the university, while the illegal alien student is given in-state tuition preference.

You don't know a lot about law, do you? Aliens are still US and state residents and pay state taxes after they have been here for 183 days, regardless of immigration status. States are free to offer a discount to in-state university students or not. They can also require people to meet special requirements for that discount. Often the residence of the parents matter, sometimes it does not. Some states offer free education for veterans, or orphans, or the handicapped, and some require a person to establish immigration status. This is in their jurisdiction. It is totally up to the state legislature and their voters. Brewer signed a law that was clearly declared unconstitutional in 1941 in Hines v. Davidowitz. Immigration is exclusive jurisdiction of the federal government and only the US Congress can pass a law sharing jurisdiction with the states. They never have done so, she knew this and only introduced the law to win the election after raising taxes and paying millions to a private prison contractor who would profit from it.
