Can someone deported for overstaying come back to UK after marriage with someone from European Union.?
-
Hello guys. Im living and working in UK for 4 years. Im from Poland and I have right to live in UK. I met Brazilian girl 2 years ago. We started dating etc. We fell in love and decided to get married. We asked Home Office for permission to get married and we have got it. We had to wait few months for it. We got it on the day when my fiance's visa expired. So lets say that was 1 of Dec and her visa was valid until 1 of Dec. We didnt know that it doesnt give her right to stay in UK. We went to civil registration office or whatever u call it and they said that she doesnt need visa if we have the document from Home Office saying we can get married in UK. From the time we have got our approval and we booked marriage ceremony to the marriage ceremony day was more or less 25 days. In the day of our wedding imigration office came to our house and arrested my fiancee for overstaying - before the wedding. She had to go back to Brazil. On the end of the day I want to be with her cos we love eachother so we will get marriage anyway in Poland or Brazil. The only thing is that I want to live in UK and I want her to be by my side! So my question is. Do u guys know if she will be able to come here after marriage to live with me. And pls dont tell my all that *** about fake marriages and imigrants living in UK. I know there is a lot of imigrants in UK but as long as Im working hard and Im paying my taxes let me be just a human, ok? And just to let u know she was here 2 years studying and working no more then government allowed her. The only thing we did wrong was our unawareness that Certificate of Approval for Marriage doesnt give her right to overstay! Any NORMAL, not offensive answer will ba appreciated.

Answer:
I am english, if I met a Brazilian in france, and wanted to get married, I would be thinking about living in either England or Brazil, not Poland or France or any other EU country, why do you not go to Brazil, get married and live there, or take her to poland, or is it because you cannot screw their benefit system as well as you can in the UK

Ignorance of the law regarding overstaying is NOT a defence. Once deported, there is normally a TEN year period before you can re-apply.

As you are Polish it is a matter for the Polish consulate/home office and it is through them that you must proceed
