What can you do if your co-workers are all illegals and you can't understand them? Any laws on this?

I've often wondered this. I have worked with illegals a couple times and they spoke no English. But it was essential that the workers communicate with one another in order to do the job. It was horrible because I couldn't understand what they were saying when they were trying to train me. My friend was asking me yesterday where he should apply for a job in this small town in which we live. He asked me if he should apply at McDonald's and at first I thought it would be a good idea because he needed to find work ASAP and most likely McDonald's is the kind of place that would hire you ASAP if they needed workers bad enough. Then I thought about it for a brief moment and said, "No way, man. Don't apply at that McDonald's because it's all illegals working there. You won't be able to understand them." And then he was like, "Yeah, you're right. That McDonald's has all illegals working there. I should apply at another fast food place such as Checker's (a fast food place here in the southeast part of the United States). Anyways, is there any recourse a worker has if he is being discriminated against because he doesn't speak Spanish? I know this question sounds crazy but it really is a reality in Florida because there are so very many illegals here.

Turn them in. McDonald's has had to pay fines before for hiring illegals. Let them pay until they stop hiring these invaders. McDonald's Franchisee Fined $1M for Hiring Illegal Aliens Thursday, July 17, 2008 RENO, Nev. — Two executives and the corporate owner of 11 northern Nevada McDonald's restaurants pleaded guilty to felony immigration charges and agreed to pay $1 million in fines. Authorities say Mack Associates Inc. employed illegal immigrants at the fast-food restaurants by giving them names and Social Security numbers belonging to others. Nevada U.S. attorney Gregory Brower says the company pleaded guilty Wednesday as a corporation to two felony charges including conspiracy and aiding and abetting. The case stems from the arrests last September of 56 people in Immigrations and Customs Enforcement raids at restaurants in Reno, Sparks and Fernley, and at franchise offices in Reno. Company directors Joe Gillespie of Sparks and former vice president Jimmy Moore pleaded guilty in federal court in Las Vegas to one charge each. About 30 of the illegal workers have returned to their native countries while the rest were allowed to stay in the United States until the case closes. I work construction in Texas, used to have the same problem when I started many, many years ago, so here's what I did,,,I learned to speak enough spanish to communicate with them, you should try it. It's a useful thing to know, especially if you live in a state like Florida or Texas.

Couple of issues- one is what you can do if you have evidence that Mickey Dee hires illegals. The other is prosecuting the corporate entity for "discrimination." If you know that there is some organized fraud going on, and that it's the corporate entity that's behind the fraud, call ICE and tell them. Be better if you have something to show the investigator apart from "I know." Discrimination is another matter. There are tons of regulations and case law. If I discriminate against you because of your race, religion, gender, etc., and you can show such, plus it cost you money (Walmart's women have won a big case, but it's on appeal) then that's "discrimination." Any issue that isn't merit-based (men working as Hooter's waitresses, for example) might have a chance. If your friend got the job, but was unhappy because the workforce spoke Spanish around him, he still got the job, right? I'm not sure you could prove discrimination because you *felt* uncomfortable with your colleagues. If you call ICE, you could get some satisfaction, but no money from a lawsuit. You could try a discrimination lawsuit, but there could be some up-front legal expenses with no guarantee of a payout. BTW, if McDonald's customers don't speak Spanish, how do they make money. This is a self-leveling effect. If I came in and asked for a cheeseburger but got a fish sandwich because the employee didn't understand English, I might pay for it, but I wouldn't go back. Like every other business, McDonald's needs repeat business. Insert a bad practice (no language) and business goes elsewhere. Just a thought. Take care!
