British visa in morocco?

Want a family visa for the uk but dont want to have to fly back to Australia. My wife and young child both have British passports and are in the UK caring for a sick relative. Im in the uk at the moment on a 6 month holiday visa and have been told I can not change the status of my visa while in the country. Can I apply for a family visa in Morocco?

Answer:
You cannot change a Visitor entry status/visa to any other type of visa. If there was any intention or expectation of staying longer than a 'visit' it should have been planned and an appropriate visa applied for at that time. To apply for any other visa you need to apply from a country of your 'residence' (i.e. where you normally live) - hence your current advice. What you may be able to do, is apply for an extension or further visitor visa based on exceptional need. But understand, that a visitor status is meant (normally) to be only 50% of the year period. So you will need to show that you have a clear plan to leave and not just keep trying extend your stay in the UK. You also have to consider how you will show that you can afford to be away from your home country (i.e. pay for your stay in the UK). A spouse visa would at least allow you to work in the UK, You do not have the right to work in the UK at present (paid or unpaid), and being in the UK on an extended basis working even for a foreign employer (where ever you are paid) would be interpreted as working. A true visit and the odd email, or a business trip is very different to that described above. If your partner and child are in the UK, why 'do' you 'need' to be here also ? again, it does sound like you have a long term intent to stay in the UK.. That means a spouse visa... applied for from your country of residence. So some answers needed about your need to be in the UK, and how you are financing that stay (and not by working remotely). http://www.ukba.homeoffice.gov.uk/visas-immigration/visiting/ - visitor visas "If you are coming to the UK as a visitor, you are allowed to stay here for up to 6 months in most cases. 'Drifting' day to day, is not a supported option.

The official answer is that you must apply for the appropriate visa from your home country, or any country where you may legally remain for more than six months. While Morocco is outside the EU, I doubt whether you would be granted a Moroccan visa valid for more than six months, and so this option is unlikely to help you. One possible loophole: as the spouse of a British citizen you have the right to live and work in any other EU country, together with your wife. So the two of you could present yourselves, your marriage certificate and her passport at the French embassy in London (or German, or whatever...). You would be given a Family Permit, entitling you to live in France. At that point you would be able to approach the British embassy in Paris to apply for the appropriate visa. However, I doubt whether your application would be successful, since you would clearly be using loopholes. there must be some flexibility for your special circumstances. Speak to someone more senior at the passport office or wherever you go for a visa. They can be human sometimes.
